Usually it knocks down to an infraction if the perp demands a jury trial as a standard plea deal (waive jury demand and they'll reduce it to a basic infraction like speeding and let you try it to a judge) Jail is discretionary. 100+ mph on a deserted stretch of road is usually different from 100+ mph on a city highway or through even light traffic.
